1. Agreement

These Terms of Service ("Terms") govern your use of the mail receiving, virtual office, and related services (the "Services") provided by OntraSpace™ ("we," "us," "our"), operating at 3505 Camino Del Rio S Ste 334 San Deigo, CA

By creating an account, submitting payment, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

We are a Commercial Mail Receiving Agency ("CMRA") registered with the United States Postal Service ("USPS") and operate under the requirements of the USPS Domestic Mail Manual, Section 508.1.8. Certain obligations described in these Terms are imposed on us by USPS and cannot be waived by either party.


2. What the Services Are — and Are Not

We provide a private mailbox at our physical location, together with mail receipt, notification, and the handling options described in your plan.

The Services do not include:

Any right to occupy, enter, or use our premises as your place of business, except as expressly permitted by your plan.

Any representation that our address may be used to obtain a Google Business Profile, a business license, or any registration that requires a staffed physical location operated by you. Google's guidelines expressly exclude rented mailing addresses from Business Profile eligibility.

Legal, tax, registered agent, or compliance advice of any kind.

You are responsible for determining whether our address satisfies the requirements of any third party — including banks, state filing offices, licensing authorities, and payment processors — before relying on it. Some institutions apply additional scrutiny to private mailbox addresses. We make no guarantee that any third party will accept your address, and rejection by a third party is not grounds for a refund.


3. Eligibility and Required Documentation

Before we may accept mail on your behalf, USPS requires that you:

a. Complete and sign USPS Form 1583, Application for Delivery of Mail Through Agent.

b. Sign or confirm your signature on that form in the physical presence, or the real-time audio-and-video presence, of our owner, manager, or authorized employee — or, alternatively, acknowledge your signature in the physical or real-time audio-and-video presence of a notary public commissioned in a United States state, territory, possession, or the District of Columbia. A notary commissioned outside the United States cannot be used.

c. Provide two forms of valid, current identification traceable to you: one primary photo identification, and one identification bearing your address.

d. List on Form 1583 every individual name, business name, trade name, and entity that will receive mail at your address. Mail addressed to any name not listed on a Form 1583 we hold cannot be accepted and will be returned to sender. If you add an entity, spouse, employee, or DBA later, you must update your Form 1583 before mail for that name arrives.

We are required to verify that your identification matches the information you supply. If it does not match, we must deny your application. Providing false or misleading information is grounds for denial of service and immediate termination, and may be reported to USPS or law enforcement.

We may not alter or modify a submitted Form 1583.

You must notify us within ten (10) days of any change to your name, home address, or the entities receiving mail at your box.


4. Your Mailing Address Format

USPS requires that mail delivered to a CMRA identify the recipient as a private mailbox holder. Your address must be used exactly as we provide it, including the designator:

The # symbol may be substituted for PMB. The designator may not be omitted, and "Suite" or "Unit" may not be used in place of it. Mail arriving without a PMB or # designation may be returned by USPS to the sender endorsed "Undeliverable as Addressed, Missing PMB or # Sign," and we are not responsible for mail returned for this reason.

We will provide your exact address format in writing when your account is activated. Use it as given. If you need it in a different arrangement for a form or filing, ask us first — we can tell you what is still compliant.


5. Prohibited Use

You may not use your private mailbox, or our address, in connection with any scheme or enterprise that violates any federal, state, or local law, or to evade service of process or any court order. This restriction is imposed by USPS.

You further may not use the Services to:

Receive controlled substances, hazardous materials, firearms, ammunition, live animals, perishable goods, or currency.

Conduct any activity involving fraud, deceptive marketing, money laundering, or misrepresentation of your business location beyond ordinary use of a mailing address.

Receive mail on behalf of any person or entity not registered on your Form 1583, including operating your own mail forwarding or re-mailing service from your box.

Represent to any third party that you lease office space, staff, or occupy our premises, unless your plan expressly includes that right.

Violation of this section permits us to terminate your account immediately, without refund, and to notify USPS and appropriate authorities.


6. Fees and Billing

Fees for your plan are as displayed at the time of purchase and are billed in advance on a recurring basis until cancelled. By subscribing, you authorize us to charge your payment method on each renewal date automatically.

We may charge additional fees for services outside your plan, including but not limited to mail forwarding postage and handling, scanning beyond plan limits, package receipt and storage, item shredding, check deposit, and account reinstatement. Current ancillary fees are listed at [LINK TO PRICING PAGE], which is incorporated into these Terms and is binding on you. Changes to that schedule are subject to the same thirty (30) days' notice as any other fee change.

Past due balances accrue a late fee of $[AMOUNT] and interest at [RATE]% per month, or the maximum permitted by law if lower. You are responsible for reasonable collection costs and attorneys' fees we incur recovering an unpaid balance.

You must keep a valid payment method on file for as long as you hold an account, and for the six (6) month period following termination described in Section 8.

We may change fees on thirty (30) days' notice to the email address on your account. Continued use after the effective date constitutes acceptance.


7. Cancellation, Suspension, and Non-Payment

Cancellation by you. You may cancel at any time. Cancellation takes effect at the end of your current paid billing period, and you retain access to the Services until that date. Fees already paid are not refunded. See our Refund and Cancellation Policy for full details.

Non-payment. If a payment fails or an invoice goes unpaid:

At 10 days past due, your account is suspended. We will continue to receive your mail as USPS requires, and you may still collect it in person during business hours. We will stop providing the value-added services in your plan — scanning, forwarding, notifications, and package handling — until the balance is paid. We do not withhold your physical mail from you as a means of collecting a debt.

At 30 days past due, your account is terminated. The six-month remailing period in Section 8 begins on the date of termination.

Termination by us. We may suspend or terminate your account immediately, without refund, for violation of Section 3 or Section 5, for failure to maintain a valid Form 1583, for a chargeback filed against a charge we can show was validly incurred, or if required to do so by USPS or law enforcement.

If we close your location. If we discontinue service at your location, we will give you at least sixty (60) days' notice, refund the unused portion of any prepaid period, and waive our handling fee on remailed items for the six-month period described in Section 8. This is the one circumstance in which we issue a refund.


8. Mail After Your Account Ends — Important

USPS requires us, under DMM 508.1.8, to remail your mail to your new address for at least six (6) months after your relationship with us ends, regardless of the reason it ended. We cannot refuse your mail during this period.

a. You can opt out, and you may want to. USPS allows you to end this obligation by giving us written instructions not to remail your mail — either all of it, or specific types of it. If you do, we stop forwarding what you've told us to stop forwarding, and you stop being billed for it. Send your instruction to [EMAIL]. If you have already redirected everything that matters, this is usually the cheapest choice. We will offer you this option in writing when you cancel.

b. Otherwise, give us a forwarding address. If you have not opted out and have not given us a valid forwarding address, we cannot remail anything. Your mail will be held, or handled as USPS directs us to handle it. We are not liable for mail that goes undelivered because we had nowhere to send it.

c. What forwarding costs. USPS requires that every remailed item carry new postage; that cost falls on us, and we pass it through to you at actual cost, plus a handling fee of $[AMOUNT] per [item / consolidated shipment]. These charges are billed to the payment method on file, [monthly / as incurred].

d. What we do not forward. Unless you tell us otherwise in writing, we do not forward Marketing Mail, bulk advertising, catalogs, or unaddressed circulars, and you are not charged for them. If you want everything forwarded, say so and it will be billed at the rates in subsection (c).

e. Keep a payment method valid. You must maintain a working payment method on file for as long as we are forwarding mail for you. Unpaid balances may be referred for collection. Non-payment does not relieve us of our USPS obligation, so it does not stop the forwarding — it only creates a debt.

f. Reduce your volume. Update your address with banks, vendors, subscriptions, and state filings promptly. The six-month obligation is a USPS floor, not a service we are marketing to you. Most of what people pay for in this window is mail they could have stopped in the first week.

g. After six months. Once the period ends, First-Class Mail, USPS Ground Advantage, Priority Mail, Priority Mail Express, and accountable mail will be returned to the Post Office endorsed as USPS requires. Remaining classes may be disposed of without further notice to you.


9. Mail Handling, Storage, and Disposal

Receipt. We accept mail and, where your plan includes it, packages from USPS and common carriers during posted business hours. We are not responsible for items a carrier fails to deliver or refuses to leave.

Storage. Unclaimed mail is held for [NUMBER] days and packages for [NUMBER] days. Storage beyond that accrues a fee of $[AMOUNT] per [period]. Items unclaimed after [NUMBER] days may be returned to sender, shredded, or disposed of.

Refusal. We may refuse any item delivered by a private carrier that is hazardous, leaking, damaged, illegal to possess, or exceeds our posted size or weight limits, and we may decline postage-due items. We may not refuse mail delivered by USPS to a current customer, or to a former customer within the six-month period described in Section 8. Certain accountable mail must be presented to you directly by USPS rather than accepted by us; where that applies we will notify you to collect it at the Post Office.

Destruction. You authorize us to shred or otherwise destroy items that remain unclaimed beyond the periods above. We will not destroy accountable mail or mail that appears to be from a government agency or a court; those are returned to sender or held. The unclaimed clock does not run during any period in which we are withholding services under Section 7.

Opening and scanning. If your plan includes scanning, you authorize us to open and scan the contents of your mail. We open mail only as directed by your plan settings or your specific instruction.

Inspection. Completed Forms 1583 and related records are retained and made available to USPS for inspection as required by DMM 508.1.8, and copies of identification documents are uploaded to the USPS CMRA Customer Registration Database. See our Privacy Policy.


10. Limitation of Liability

The Services are provided "as is." To the maximum extent permitted by law:

We are not liable for the loss, theft, delay, misdelivery, damage, or destruction of any mail or package caused by USPS, a carrier, or a third party. Nothing in these Terms limits our liability for our own gross negligence, willful misconduct, or fraud, or for any liability that cannot be limited under applicable law.

We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits or business opportunity, arising from the Services.

Our total aggregate liability for any claim is limited to the amount you paid us in the three (3) months preceding the event giving rise to the claim.

Do not have irreplaceable, high-value, or time-critical items sent to your mailbox. We do not insure the contents of mail and carry no liability for declared or undeclared value.


11. Indemnification

You agree to indemnify, defend, and hold harmless OntraSpace™, its owners, officers, employees, and agents from any claim, demand, loss, liability, fine, or expense (including reasonable attorneys' fees) arising from your use of the Services, your breach of these Terms, your violation of any law, or any third party's claim relating to mail sent to or from your address.


12. Legal Process and Disclosure

We may disclose your identity, Form 1583, identification documents, mail records, and account information without notice to you where required by law, court order, subpoena, or a lawful request from USPS, the Postal Inspection Service, or law enforcement. USPS is entitled to inspect our Form 1583 records at any time.


13. Changes to These Terms

We may update these Terms. Material changes will be sent to the email address on your account at least thirty (30) days before taking effect. Continued use after the effective date constitutes acceptance. The current version always governs and is posted at [LINK].


14. Governing Law and Disputes

These Terms are governed by the laws of the State of CA, without regard to conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in San Diego County, and you consent to that jurisdiction.


15. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and Refund and Cancellation Policy, are the entire agreement between us.

Severability. If any provision is found unenforceable, the remainder stays in effect.

Assignment. You may not assign your account or transfer your mailbox to another person or entity. We may assign these Terms in connection with a sale or transfer of the business.

No waiver. Our failure to enforce any provision is not a waiver of it.

Survival. Sections 6, 8, 10, 11, 12, and 14 survive termination.

Time limit on claims. Any claim relating to billing must be raised with us within thirty (30) days of the charge.

Death, incapacity, or dissolution. A mailbox is registered to the names on your Form 1583 and cannot be transferred. If you die, become incapacitated, or your entity dissolves, an executor, personal representative, or successor must provide documentation of their authority before we can release mail or close the account. Until then, mail is held.

Use of the address after termination. You must stop using our address on filings, websites, listings, invoices, and accounts once your account ends. You remain responsible for the cost of handling mail that continues to arrive because you did not.
